Privacy Policy

Effective as of March 1, 2022

This privacy policy (“Privacy Policy”) applies to the Zen Technologies Inc. mobile application, Zen Shuttles (“App”), owned and operated by Zen Technologies Inc. (“Zen Shuttles”). This Privacy Policy tells you what information the App collects, how that information is used, and who that information is shared with, if at all. This Privacy Policy does not address the privacy practices of any third-parties. By visiting and using the App, you are agreeing to the terms of this Privacy Policy and the accompanying Terms of Conditions. 

  1. INFORMATION COLLECTED OR RECEIVED. 

1.1 Information collected or received. You authorize Zen Shuttles to collect and receive the following types of information while operating the App:

a. Personal information. Zen Shuttles does not collect any Personal Information from you when you use the App unless you provide the Personal Information voluntarily. Zen Shuttles only receives or collects information that identifies you personally if you provide such personally identifiable information. When you sign up to become a user of Zen Shuttles, you will be required to provide personal information about yourself (collectively, the “Personal Information”). When you contact Zen Shuttles, you will be required to provide Personal Information. Such Personal Information may include your name, phone number, age, and e-mail address. 

b. Payment information. You will be required to provide Zen Shuttle’s third-party payment affiliate, Stripe, with your payment information. Payment information may include, without limitation, bank account numbers, credit card or debit card numbers, account details, and similar data (collectively, “Payment Information"). Stripe will collect and process such Payment Information pursuant to Stripe’s privacy policies and terms of use. Zen Shuttles does not obtain access to any Payment Information connected to such purchases or subscriptions.

c. Geolocation Information. Many features and functionalities of the App are based on your location. To provide these features and functionalities while you are using your mobile device, Zen Shuttles may, with your consent, automatically collect geolocation information from your mobile device or wireless carrier (collectively, “Geolocation Information”). Geolocation Information is only collected when the App is running on your device. You may decline to allow Zen Shuttles to collect such Geolocational Information, in which case Zen Shuttles and the App will not be able to provide certain features or functionalities to you.

1.2 Third-party analytics. Third-party technology providers use third-party analytics services to evaluate your use of the App. Third-parties may compile reports on activity and collect demographic data. Third-parties may also evaluate performance metrics and collect other information relating to the App and usage. You consent to data processing by these analytics providers. Please be advised that if you opt-out of any such service, you may not be able to use the full functionality of the App.

1.3 Other information. Zen Shuttles may collect additional information in addition to the Personal Information, Payment Information, and Geolocation Information. This may be information regarding you, your use of the App, your mobile device used to access the App (collectively, “Other Information”). Such Other Information may include:

(a) Additional information about yourself that you voluntarily provide to Zen Shuttles.

(b) Information regarding:

(i) IP address;

(ii) date and time; 

(iii) details about your activity on the App, including performance and usage data;

(iv) type of mobile device; 

(v) operating system and version (e.g., iOS or Android);

(vi) carrier; and

(vii) network type (WiFi, 3G, 4G, 5G, LTE).

(c) Zen Shuttles may use session cookies in the App, which expire once you close the App, to collect data, enhance, and personalize your experience. Zen Shuttles may use persistent cookies in the App, which stay on your mobile device until you delete them, to help collect data, enhance, and personalize your experience. If you do not want Zen Shuttles to deploy cookies in the App, you can opt-out by setting your mobile device to reject cookies. You can still use the App if you choose to disable cookies, although your ability to use some of the features may be affected.

  1. USING AND SHARING INFORMATION.

2.1 Usage. You authorize Zen Shuttles to use Personal Information, Payment Information, Geolocation Information, and Other Information (collectively, “Information”) to:

a. provide and improve the App;

b. provide services; and

c. solicit your feedback.

2.2 Third-party companies. Zen Shuttles engages third-party companies and individuals to perform certain functions. These third-party companies will have access to Information only as necessary to perform their functions. These third-party companies will have access to Information to the extent permitted by law.

2.3 Analytics. Zen Shuttles and the App may analyze certain Information in anonymized and aggregated form. This aggregate information will serve to operate, maintain, and improve the App and its services. This aggregate information does not identify you personally. Zen Shuttles may share this aggregate data to its affiliates, agents, business and promotional partners, and other third parties. Zen Shuttles may license this aggregate data to its affiliates, agents, business and promotional partners, and other third parties. Zen Shuttles may disclose aggregated user statistics to describe the App and services to current and prospective business partners, investors, and other third-parties for other lawful purposes.

2.4 Transferred assets. As Zen Shuttles develops its businesses, Zen Shuttles might sell or buy businesses or assets. The Information may be part of transferred assets in the event of a corporate sale, merger, reorganization, sale of assets, dissolution, or similar event.

2.5 Other lawful disclosures. To the extent permitted by law, Zen Shuttles may also disclose the Information:

(a) when required by law;

(b) when required by court order;

(c) when required by other government or law enforcement authority or regulatory agency; 

(d) whenever Zen Shuttles believes that disclosing such Information is necessary or advisable to protect the rights, property, or safety of Zen Shuttles or others, including you; or

(e) whenever Zen Shuttles believes that disclosing such Information is necessary or advisable to protect the rights otherwise.

  1. PROTECTING YOUR INFORMATION. 

Zen Shuttles takes commercially reasonable steps to protect the Information from misuse, unauthorized access, disclosure, or alteration. Zen Shuttles cannot guarantee the security of its databases or the databases of the third-parties with which it may share such Information. 

  1. APP STORES.

Your app store may collect certain information connected to your use of the App, such as Personal Information, Payment Information, Geolocation Information, and other usage-based data. Zen Shuttles has no control over the collection of such information by a third-party app store. That third-party’s privacy policies will govern any such collection or use of the information. 

  1. MINORS.

The App is not directed to minors under the age of 18. Zen Shuttles will not knowingly collect Personal Information from any minor under the age of 18. Zen Shuttles asks that minors (under the age of 18) not use the App. A parent or guardian of a minor, under the age of 18, that has provided Zen Shuttles or the App with Personal Information may contact Zen Shuttles and request that such information be deleted.

  1. CHANGES TO THE PRIVACY POLICY. 

This Privacy Policy is effective as of the date stated at the top of this Privacy Policy. Zen Shuttles may change this Privacy Policy at any time. Any changes will be posted on the App and will require a new agreement. You are construed to have accepted the changes by accessing the App after any such changes to this Privacy Policy and agreeing to the new Privacy Policy. Zen Shuttles may use the Information to the extent permitted by applicable law. Use of the Information is governed by the Privacy Policy in effect at the time the Information is collected.
